This agreement applies to anyone who donates to, backs with a reward, buys a product or service through a pre-sale in, or invests in a campaign on Donation Center (the "Backer"). It is accepted when you give your support. The Cancellation and Refund Policy forms part of this agreement.
1. The parties and the role of Donation Center
- The party that opens the campaign and will use the money raised is the Campaign Owner. The Campaign Owner is responsible for the information, promises and rewards on the campaign page.
- Donation Center is the intermediary that publishes campaigns, takes your payment and holds it in escrow until the campaign concludes. It does not guarantee the Campaign Owner's promises.
2. Types of support
- Donation: a gift with nothing in return. You receive no goods, services or rights in exchange for a donation.
- Reward-based support: you support the campaign; the Campaign Owner provides the thank-you, product or experience described on the page.
- Pre-sale: you buy the product or service described on the campaign page, with the estimated delivery time stated there. This support is a sales contract; the seller is the Campaign Owner.
- Investment and lending: if the campaign raises funds in exchange for shares, a revenue share or debt, you will also be asked to accept the Investment and Lending Risk Disclosure.
3. Payment
- The amount, currency and any package you chose are shown on the payment screen. The contract is formed when you confirm the payment.
- Your payment is taken through payment service providers. If the provider of your payment method charges an extra fee, it is shown to you separately.
- Currency conversion costs and fees charged by your bank may be borne by you.
4. Where your money is held
- While the campaign is running, your payment is held by Donation Center in an escrow account set aside for the campaign.
- When the campaign ends, the money is paid out to the Campaign Owner.
- If the campaign was opened on an "all or nothing" basis and the target was not reached, your payment is refunded to you.
- If the campaign is paused or ended because of a breach of the rules, the amount in escrow is refunded.
5. Cancellation, withdrawal and refunds
- Because donations are gifts, they are not refunded unless the campaign is ended for a breach of the rules or an "all or nothing" campaign does not reach its target.
- For pre-sales and reward-based support, you may ask the Campaign Owner for a refund if the product or reward is not delivered or is delivered materially different. Any right of withdrawal for distance sales or other rights that the law of your country gives you remain unaffected.
- The details are in the Cancellation and Refund Policy.
6. Information shown publicly
- When you give your support, you can choose whether your name and your support appear on the campaign page. If you choose anonymous support, your name is not shown publicly.
- A message you write with your support may be published on the campaign page; messages may be moderated by the team.
- Your name, contact details and the details of your support are shared with the Campaign Owner so that it can deliver rewards and meet its legal obligations. If you chose anonymous support, this information is used only for these purposes and is not made public.
7. Support without an account
If the site allows it, you can give support without signing in. In that case, the name and e-mail address you provide are used to record your support, and your support may be linked to the account belonging to that e-mail address.
8. Tax and receipts
The Campaign Owner is responsible for issuing donation receipts, invoices or documents needed for tax relief. Donation Center gives no assurance about how your donation will be treated for tax purposes.
9. Misuse
You do not use a payment method that belongs to someone else, and you do not give support for money laundering, sanctions evasion or any other unlawful purpose. Suspicious transactions may be stopped, refunded and reported to the competent authorities.
10. Liability
The Campaign Owner is responsible for its promises, the delivery of rewards and the outcome of the campaign. Donation Center is responsible for operating the escrow and refund rules in line with this agreement; to the extent the law allows, it is not liable for indirect losses.
11. Changes
This agreement may be updated; your support is governed by the version in force at the time you gave it.
